New California Law to Protect Workers Using Cannabis Off The Job

A new law will take effect in 2024 protecting California employees who use weed products off the clock.  But it doesn’t cover all industries. 

Under Assembly Bill 21-88, employers can only punish workers for being impaired on the job.  It’s a section added to the California Fair Employment and Housing Act, which bans various forms of employment discrimination. 

The new law doesn’t apply to the building and construction trades, or “those hired for positions that require federal background checks and clearance.” 

Several questions are arising, like how to prove an employee is high on the job because cannabis can last in the system for up to three months, according to medical experts. 

Employers will keep their right to declare a drug- and alcohol-free workplace.
